Terms :
(A) This contract is NON-CANCELLABLE by advertiser.
(B) Advertiser acknowledges upon signing of this contract that he/she has read this contract and has not relied upon any promise, statement or representation other than contained herein.
(C) Payments are non-refundable.
(D) It is agreed that this contract shall be binding upon the heirs, executors, administrators, assigns of the parties here to and any and all new owners.
(E) If proof is requested, corrections there to must be returned by the date indicate on said proof. Failure to timely forward all corrections by the date indicated will constitute your consent to the proof as presented and to its subsequent publication. Advertiser further agrees to hold Resident News harmless from any infringement of any copyright or other intellectual property right based on any material submitted to Resident News under the terms of this Agreement.
(F) On any amounts overdue by thirty (30) days or more, customer agrees to a service charge of 1.5% per month (18% APR which is added to all overdue accounts).
(G) Final Approval of this contract must be made by resident News home office.
(H) Attorney Fees and Costs of Litigation : In the event Merchant breaches or defaults under this Agreement, Merchant agrees to pay all reasonable attorney fees and costs of litigation incurred in enforcing this Agreement and collecting any sums due hereunder.
(I) In the event this agreement is terminated early or breached, the full balance of the agreement is due immediately.
(J) Resident News reserves the right to cancel and change out properties at any time during this agreement. However, a New property must replace the terminated property with equal or greater number of units and must be within 5 mile radius of existing locations.
(K) There is a $39 charge for any bounced checks and a $25 charge for all credit card payments that are declined.
(L) Resident News is not responsible for sending copies of completed newsletters to client. To see actual newsletter, client must visit paid location and pick up a copy. Merchant is responsible for bringing any inserts/flyers to property before the end of the month to ensure inclusion and/or distribution. Resident News is not liable or responsible for this.
